What Can Happen When Re-Entering Argentina After a Previous Immigration Issue?

A previous immigration history in Argentina may be relevant when you attempt to enter the country again. This is not limited to having overstayed your authorized period of stay as a tourist.

Other circumstances may also become relevant, including having previously initiated an immigration procedure in Argentina that was not completed, having obtained a temporary immigration status that subsequently expired, having allowed an immigration proceeding or authorization to lapse without initiating a new procedure, or having left the country without regularizing an outstanding immigration situation (among other).

When you next attempt to enter Argentina, you may be referred to secondary immigration inspection by the Argentine immigration authorities at the border (airport, sea or land). During this process, you may be asked a series of questions regarding your identity, previous stays in Argentina, activities in your country of residence, family ties in Argentina, and your previous immigration procedures.

The authorities may take a formal statement from you and consider your answers, together with the information available in the immigration control systems and the records of the National Immigration Office (Dirección Nacional de Migraciones), when assessing whether to authorize your entry into the country. This formal statement may be reviewed later on, in eventual and future immigration procedures.

Why does your previous immigration history matter?

Your immigration history is not limited to your entries and exits from Argentina.

It may also include immigration procedures, applications, permits, residence proceedings, and other records generated during previous stays in the country.

For example, particular attention may be appropriate if you previously:

  • overstayed the period authorized as a tourist;
  • initiated a residence or other immigration procedure but did not complete it;
  • obtained an immigration status or authorization that subsequently expired;
  • allowed an immigration procedure to lapse without completing it or initiating a new procedure;
  • left Argentina while an immigration matter remained unresolved;
  • initiated a procedure at the National Immigration Office or an Argentine consulate but never completed the process;
  • had previously received a decision, notification, or request for additional documentation that was not subsequently addressed;
  • had previously been subject to an expulsion order or an order to leave the territory.

The existence of one of these circumstances does not automatically mean that you will be denied entry. The consequences depend on the particular facts of each case and on the information contained in the relevant immigration records.

However, it is important to understand your previous immigration history before traveling again.

Previous immigration procedures

During a secondary inspection, you may be asked whether you previously initiated any immigration procedure in Argentina or at an Argentine consulate.

If you did, the authorities may ask:

  • what type of procedure you initiated;
  • when and where it was initiated;
  • whether it was completed;
  • whether you received a decision or notification;
  • whether you were asked to provide additional documentation;
  • whether the procedure expired, was cancelled, or was otherwise discontinued; and
  • whether you subsequently initiated another immigration procedure.

The information you provide may be compared with the records maintained by the Argentine immigration authorities.

For this reason, it is important to know what happened with any previous immigration procedure before attempting to enter Argentina again.

Preparation before traveling

If your previous immigration history was not entirely straightforward, it is advisable to review your situation before traveling.

This is particularly important if you:

  • previously overstayed in Argentina;
  • started a residence application that was never completed;
  • had an immigration authorization that expired;
  • left Argentina after an immigration procedure had been initiated but before it was completed;
  • have not initiated any new procedure after a previous immigration status expired; or
  • are unsure about what appears in your immigration records.

Preparing in advance can help you understand your previous immigration history, identify potential issues, gather relevant documentation, and be prepared to provide complete and truthful explanations if questions arise during the entry process.

This does not mean concealing information or attempting to circumvent immigration controls. On the contrary, proper preparation means understanding your immigration history, having appropriate supporting documentation, and providing complete and truthful information to the authorities.

Los profesionales que intervienen en cada asunto mantienen un registro detallado de las gestiones realizadas, lo que permite brindar, en cualquier momento, información precisa sobre las tareas desarrolladas y el estado de avance de la intervención encomendada.

La correcta ejecución de los encargos profesionales requiere la colaboración de la persona consultante, incluyendo la provisión en tiempo y forma de información, documentación y toda otra gestión necesaria para el adecuado desarrollo del asunto.

Salvo en aquellos supuestos que, por sus características particulares, justifiquen una modalidad diferente, los honorarios del estudio no se determinan exclusivamente sobre la base de una tarifa horaria. En términos generales, formulamos una estimación económica a partir de un análisis preliminar del asunto, considerando su complejidad, alcance y las actuaciones que razonablemente puedan preverse al inicio de la relación profesional.

Dicho análisis se realiza en el marco de una consulta inicial arancelada, durante la cual la persona consultante recibe una primera valoración profesional de su situación y, cuando corresponda, una propuesta económica para la asistencia solicitada. Cuando la naturaleza o complejidad del asunto requiera un examen más exhaustivo -incluyendo el análisis de documentación, expedientes, antecedentes, normativa aplicable u otros elementos relevantes- podremos acordar un honorario adicional por las tareas de estudio y evaluación preliminares.

Toda estimación de honorarios tiene carácter orientativo y podrá ser objeto de revisión en función de la evolución del asunto, la aparición de circunstancias sobrevinientes o la necesidad de realizar actuaciones no contempladas al momento de su formulación. No obstante, nos comprometemos a comunicar de manera previa y oportuna cualquier modificación relevante y a procurar un acuerdo respecto de sus implicancias económicas antes de avanzar con nuevas intervenciones.

Los presupuestos se elaboran sobre la base del escenario fáctico y jurídico informado al momento de la consulta o del análisis preliminar. En caso de verificarse demoras significativas atribuibles a la falta de colaboración de la persona consultante, o modificaciones sustanciales de dicho escenario, el alcance de las tareas y los honorarios podrán ser revisados conforme a criterios de razonabilidad y proporcionalidad, atendiendo a las nuevas circunstancias del caso y al impacto que estas pudieran tener en la complejidad, extensión o duración de la intervención profesional.

Las condiciones económicas aplicables a cada intervención son acordadas de manera individual al inicio de la relación profesional, atendiendo a las particularidades de cada situación. Procuramos mantener criterios de razonabilidad y accesibilidad, prestando especial consideración a las personas humanas, las organizaciones sin fines de lucro y aquellas personas o entidades con recursos económicos limitados.
